Effective February 22, 2008:
Pursuant to Ohio Revised Code 5302.221, all Affidavit of Transfer on Death to be recorded after a persons death must include the completed form "Ohio Medicaid Estate Recovery Form" prior to transfer or recording. Once the Recorder's Office has received the required information, they will submit the forms with a copy of the deed to the Medicaid Recovery Administrator. These forms are required for all Affidavit of Transfer on Death filed after a persons death. If you have questions regarding this new law, please consult an attorney. The Lorain County Recorder's Office is not allowed to provide legal advice.
