78.2 Withdrawal by Attorney of Record
- Any withdrawal by an attorney of record shall be made in accordance with Rule DR2-110 of the Code of Professional Responsibility. In addition, counsel of record shall not withdraw from representation in the case without permission of the court once the case has been set for pre-trial or trial.
- Where an attorney files an application to withdraw as counsel representing a fiduciary, the matter shall be set for hearing and the fiduciary shall be notified and may be present at the hearing, unless notice and hearing is dispensed with by the Court.
- If a fiduciary has employed an attorney and no longer desires to retain him for the performance of legal services relating to the administration of an estate, the fiduciary shall notify the Court in writing of the termination of such services and furnish a copy of said notice to the attorney.
