* 1. Exceptions:

    a. There will be a three (3) exception maximum. Any deed having more than three must show the last deed of record, which must match identically the legal you are presenting for transfer. The deed will then receive an "Update Legal" stamp and must show a corrected description before the next transfer.

    b. Exceptions must contain deed volume & page or instrument number, date, acreage or sublot size, and who it transferred to.

    c. Any deed with an exception must have a statement of what they are "intending to convey." (ie: intending to convey 2.50 acres)

* 2. Deed Review: If the legal description does not match the auditors records on a deed that is being presented for transfer, the deed itself or a photo copy, must be submitted to the Transfer Department to be reviewed by the Tax Map Department 24 hours before the deed is going to transfer.

3. Update Legal Stamp: "Update Legal" stamp will be used on all legal descriptions presented for transfer that the unit of measurement is not in feet (tenths) or meters (centimeters). The stamp will also be used in the case that the parcel is unrecognizable. References to abounding land owners must be current. When the "Update Legal" stamp is used on a legal description the computer will be flagged to reflect that the legal will need to be corrected before that next transfer.

* 4. Acceptable legal description: Legal descriptions are to contain sublot number & subdivision name along with the volume and page or instrument number of the recorded plat. If the sublot has been altered (shifted lines, split etc.) the legal description must read around the perimeter. (Survey may be required).

5. Special Requirements: Special requirements for all documents, including court order transfers are as follows:

    a. All deeds must have prior deed of record volume and page or instrument number.

    b. All deeds must contain the caption phrase. (Situated in the State of Ohio, County of, and City/Twp/Village of )

    c. All deeds must contain a statement of the complete tax mailing address of grantee.

    d. Any property transferring with Homestead or C.A.U.V. reductions must have DTE forms 101 or 102, which ever one applies, attached. (see exhibit "B")

    * e. An "Affidavit of Successor Trustee" must be filled out in order to transfer property from one trustee to another. (i.e.: death, resignation etc.)

* 6. One Legal - Two Parcels / Two Legals - One Parcel: The purpose of the following rules is to have the maps match the deeds therefore:

    a. A description having one (1) legal description and two (2) parcel numbers on the Auditor's records may be combined (excluding sublots & some crossing of original lot lines).

    b. A description having two (2) legal descriptions and one (1) parcel number on the Auditor's record must show a copy of a deed of record prior to 1980 showing the property as two (2) legals. The options, in this case are to file the deed as is and the property will be split back to two parcel numbers or to have a corrected legal written that reads all the way around the perimeter and the "one" parcel number will stand as it is.

7. Matching Deeds to Maps: All metes and bounds legal descriptions listing acreage on the county auditor records, must contain acreage on the deed to be transferred.

Alley Vacations / Street Vacations / Railroad Vacations: If a legal description does not match the Auditor's records and it is because of a vacation of an alley, street, or railroad the deed being presented must mention so. It is preferred that the ordinance number, if available, be on the deed.
